Aggravated Assault

Aggravated assault under Florida Statute § 784.021 is an intentional, unlawful threat by word or act to commit violence, coupled with an apparent ability to do so and creating a well-founded fear — committed with a deadly weapon or with intent to commit a felony. It is a third-degree felony (5 years, $5,000 fine) and a 3-level offense under Florida's sentencing matrix. Defenses include lack of apparent ability, no well-founded fear, self-defense, and verbal-threat-only arguments that fail the elements test.
