Hit and Run

Leaving the scene of a crash is charged under Florida Statute § 316.061. A crash involving property damage alone is a second-degree misdemeanor (up to 60 days jail), but leaving the scene of a crash involving injury is a third-degree felony, and one involving serious bodily injury or death is a first-degree felony punishable by up to 30 years — with a 4-year mandatory minimum for serious injury. Defenses include lack of knowledge that a crash occurred, immediate self-reporting, and mistaken vehicle identification.
