Habeas Corpus

A civil writ used to challenge the legality of a person's detention. In Florida criminal defense, habeas corpus petitions test whether a conviction, sentence, or bond decision violated constitutional or statutory rights. Petitions may be filed in state circuit court, the Florida Supreme Court, or federal court under 28 U.S.C. § 2254.
