Trespass

Trespass in Florida covers entering or remaining on property without authorization. Trespass on property other than a structure or conveyance is charged under § 810.09 (second-degree misdemeanor), while trespass in a structure or conveyance under § 810.08 is a first-degree misdemeanor and becomes a third-degree felony if armed or the occupant was present and warned. Defenses include lack of posted or verbal warning, good-faith misunderstanding of authorization, and leaving promptly after notice.
