Drug Paraphernalia
Possession of drug paraphernalia violates Florida Statute § 893.147 and is a first-degree misdemeanor, punishable by up to one year in jail and a $1,000 fine. Anything used to ingest, package, or manufacture controlled substances can qualify, from pipes to baggies with residue. Defenses challenge whether the item actually constitutes paraphernalia, whether residue tested positive for an illegal substance, and whether the search that found it was lawful.
